Why Ferdinand Waititu Will Not Be Fully Free Even After Leaving Kamiti Prison

Former Kiambu Governor Ferdinand Waititu is expected to walk out of Kamiti Maximum Prison after securing a KSh 53 million bank guarantee, a move that satisfies the alternative fine imposed by the court.

Waititu has been in prison since February following his conviction in a KSh 588 million graft case, where he received a 12-year sentence or an option to pay KSh 52.5 million.

Payment of the KSh 53 million guarantee now clears the way for his release from Kamiti. However, despite regaining his physical freedom, Waititu’s legal battles are far from over.

Even after he steps out of prison, Waititu will not be entirely free, because he still faces ongoing charges in a separate hate speech case.

His previous bond terms in that matter remain active, meaning he must continue attending court as required. The prosecution has already confirmed its readiness to proceed, and the next hearing is scheduled for January 15, 2026.

This means that while Waititu may leave Kamiti, he continues to operate under strict legal obligations. Any failure to comply could place him back in trouble.

The former governor’s situation highlights how court processes can continue to bind a person even after securing temporary freedom from one case.
